Terms of Sale
Last updated: August 2026
These terms govern orders placed with Forever Photo (“we”, “us”) through our website. By placing an order you agree to them. They apply alongside our Privacy Policy, Returns & Refunds, and Shipping pages.
Who we are
Forever Photo is a trading name operated from Kildridge House, Sandy Rise, Chalfont Heights, SL9 9TR, United Kingdom. You can reach us at hello@foreverphoto.co.uk.
The product
Each Forever Photo is a personalised, giclée fine-art print of a photograph you supply, made to your specification in a chosen size and with a chosen frame (or none). A QR code is printed beneath the photograph which, when scanned, opens a private page that plays a video or audio memory you also supply. Because each print is made to your personal specification and printed with your own image, it is a personalised item.
Ordering and payment
You place an order through our five-step process: upload your photograph, upload your memory, choose a size, choose a frame, and enter your delivery details. The total payable is shown before payment and includes the print, the frame (if any), and a live shipping quote from our fulfilment partner for your chosen delivery country and method. Payment is taken securely by our payment provider, Square. An order is only accepted once payment is confirmed and we email you an order reference.
Your content
You confirm that you own, or have the right to use, any photograph, video and audio you upload, and that it does not infringe the rights of any third party or break any law. You grant us a licence to use that content solely to make and fulfil your print and to make the memory page available to anyone who scans your code. We will not otherwise publish or share your content.
Memory storage and availability
The video and audio memories you upload are stored and streamed by a third-party hosting provider on our behalf. We are not responsible for, and accept no liability in respect of, any failure, outage, suspension, data loss, or future unavailability of that storage provider which prevents the memory linked to your QR code from being recalled or played back. We will use reasonable endeavours to keep your memory accessible, but we cannot guarantee uninterrupted or indefinite availability of any memory where that availability depends on the continued operation of a third-party storage service. Any liability we do have in connection with your memory is subject to the limitations in the Liability section below.
Cancellation — personalised goods
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel a distance contract. However, the right to cancel does not apply to goods made to the consumer’s specification or clearly personalised — which includes every Forever Photo print. For that reason, once your order is accepted and sent to production you cannot cancel it for a change of mind. This does not affect your statutory rights when goods are faulty, damaged, or not as described — see our Returns & Refunds page.
Delivery
Delivery is made by our fulfilment partner. Production and delivery times are given as guidance only and may vary; we will not be liable for delays outside our reasonable control. See our Shipping page for the methods available and how tracking works.
Liability
Nothing in these terms limits any liability that cannot be excluded by law. To the extent permitted by law, our liability for any single order is limited to the amount you paid us for that order. We are not liable for indirect or consequential loss.
Governing law
These terms are governed by the laws of England and Wales, and any dispute will be dealt with by the courts of England and Wales.
